1. Acceptance 
The Creative Futures Online Community is provided free of charge to you by Creative Futures Partnership under these Terms of Service. By using the Creative Futures Online Community you are agreeing to be bound by these Terms of Service. 
These Terms of Service govern your use of the Creative Futures Online Community whether you are a member, a subscriber or a visitor and govern all services provided to you by the Creative Futures Online Community, including but not limited to, access to message boards and use of any e-mail accounts, and other features and services such as personal home pages, provided from time to time.
If you do not agree to these Terms of Service, please do not enter the Creative Futures Online Community or register as a member or subscribe to our newsletters.
2. Amendments 
We reserve the right to amend these Terms of Service from time to time without notice to you.
You will be able to access the Terms of Service throughout the Creative Futures Online Community. Please check the Terms of Service periodically to determine whether a change has been made to them. If you do not agree to changes in the Terms of Service as they may occur, please terminate your registration with us immediately and discontinue your use of the Creative Futures Online Community. Your continued use of the Creative Futures Online Community will signify your acceptance of any change in the Terms of Service set out here.
3. Registration 
When you register with us you are stating that you are over 18 years of age or are a minor with parental consent to use the service you are registering for. PLEASE NOTE that all minors are recommended to discuss these terms and conditions with their parents or legal guardian before they complete any registration process or provide us with any information about themselves. We do not allow persons who we know to be 13 years of age or younger to register with the Creative Futures Online Community.
In return for allowing you to access the Creative Futures Online Community and to benefit from our services, you agree that any information you provide to us about yourself upon registration or at any other time will be true, accurate and complete and that you will ensure that this information is kept accurate and up to date at all times.
4. Password and Security 
When you register to use the Creative Futures Online Community you will be given or asked to create a password. You must keep this password confidential and must not disclose it to or share it with anyone. PLEASE NOTE that you will be responsible for all activities that occur under your password. If you know or suspect that someone else knows your password you should notify us immediately at: admin@Creative Futures.org.uk
If you forget your password please contact us at admin@Creative Futures.org.uk and we will be able to remind you of your password once you have satisfied our security check.
5. Privacy Policy 
We treat your privacy very seriously and we understand that you will wish to know how we will use the information we collect from you. All use of your personal information will be in accordance with our Privacy Policy and will comply with all applicable UK data protection legislation.
6. Content of Messages 
You alone are responsible for the content of your messages and the consequences of any such messages.  Croydon Primary Care Trust reserves the right to restrict, suspend or terminate your registration if it becomes aware and determines, in its sole discretion, that you are violating any of the following guidelines: 
i. You may not use the Creative Futures Online Community or any subscriber's information, personal or otherwise, for any commercial purpose or to obtain direct financial gain (e.g. mass marketing). Creative Futures Online Community is to be used by you for your personal use only. Commercial uses of Creative Futures Online Community are strictly prohibited unless prior written consent from Creative Futures Online Community has been granted for such use.
ii. The Creative Futures Online Community must not be used for chain letters, junk mail, 'spamming', solicitations (commercial or non-commercial) or bulk communications of any kind (including but not limited to sending messages to distribution lists) unless the recipient has given specific permission to be included in such a list.
iii. The Creative Futures Online Community must not be used to send or distribute any message or material that is unlawful, harassing, libellous, defamatory, abusive, threatening, harmful, vulgar, obscene, profane, sexually oriented, threatening, racially offensive, inaccurate or which otherwise includes objectionable material of any kind or nature (including but not limited to, illegal material in the form of text, graphics, video, programs or audio) or that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable local, national or international law or regulation. No such message or material must be distributed or sent via Creative Futures Online Community or posted on message boards or placed on Creative Futures Online Community. Creative Futures Online Community reserves the right to delete any such material from Creative Futures Online Community.
iv. You must not impersonate any other person or entity, whether actual or fictitious.
v. You must not use an inappropriate member name of any kind.
vi. You may not post content or participate in any form of discussion with the intention to commit any illegal activity.
vii. You must not use the Creative Futures Online Community or any part of the Creative Futures Online Community in a way that might reasonably be expected to cause the same to be interrupted, damaged, rendered less efficient or which could in any way damage the operation of another's computer.
7. Intellectual Property 
You acknowledge that (i) the Creative Futures Online Community permits access to content that is protected by copyrights, trademarks and other intellectual and proprietary rights ("Rights"); (ii) these Rights are valid and protected in all media and technologies existing now or later developed; and (iii) except as explicitly provided otherwise, these Terms of Service and applicable copyright, trademark and other laws govern your use of such Rights. You may not post to the Creative Futures Online Community, copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer any material subject to any Rights. The burden of determining that any information, software, images or any other content on the Creative Futures Online Community is not protected by Rights rests with you. You acknowledge that you will not acquire any Rights by downloading any materials on Creative Futures Online Community.
By submitting content, which shall include your member name, to any "public area" of the Creative Futures Online Community, including message boards, forums, contests and chat rooms, you grant Creative Futures Online Community and its affiliates a royalty-free, perpetual, irrevocable, non-exclusive right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any Rights that may exist in such content.
You also warrant that the holder of any Rights, including moral rights, in such content (whether this is you or a third party) has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the licence stated above. You also permit any member to access, display, view, store and reproduce such content for personal use. Subject to the foregoing, the owner of such content placed on the Creative Futures Online Community retains any and all Rights that may exist in such content.
However, the Creative Futures Online Community undertakes not to publish member content without informing the member.
8. Modifications of the Site 
The Creative Futures Online Community may modify or discontinue the Creative Futures Online Community with or without notice to you and without liability to you or any third party.
9. Termination 
The Creative Futures Online Community reserves the right, at its sole discretion, immediately, without notice to you to restrict, suspend or terminate (i) these Terms of Service; (ii) your registration with or ability to access Creative Futures Online Community and/or any other service provided to you by Creative Futures Online Community (including any e-mail account) upon any breach, or suspected breach by you of the Terms of Service (as determined in Creative Futures Online Community's sole discretion). The restriction, suspension or termination of our service pursuant to this section will be without prejudice to any rights which Creative Futures Online Community may have against you in respect of your breach of these Terms of Service. 
10. Disclaimer of Warranties 
The Creative Futures Online Community is provided on an "as is" and "as available" basis. The Creative Futures Online Community expressly disclaims all warranties or representations of any kind, express or implied, to the fullest extent permitted by law.
You understand and agree that the Creative Futures Online Community does not guarantee the accuracy or completeness of any information in or provided in connection with Creative Futures Online Community. Creative Futures Online Community is not responsible for any errors or omissions or for the results obtained from the use of such information. The information is provided with the understanding that neither Creative Futures Online Community, its employees or consultants or its members, while such members are participating in Creative Futures Online Community, are engaged in rendering legal, medical, counselling or other professional services or advice. Creative Futures Online Community encourages you to seek appropriate professional advice or care for any situation or problem which you may have.
The Creative Futures Online Community shall not be responsible for any loss or damage caused, or alleged to have been caused, directly or indirectly, by the information or ideas contained, suggested or referenced on Creative Futures Online Community Connect. Your participation in Creative Futures Online Community is solely at your own risk. No advice or information, whether oral or written, obtained by you from Creative Futures Online Community or through Creative Futures Online Community shall create any warranty not expressly made in these terms of service or imposed by law.
11. Limitation of Liability 
To the fullest extent permitted by law the Creative Futures Online Community shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use Creative Futures Online Community or messages received or transactions entered into through Creative Futures Online Community or resulting from unauthorised access to or alteration of your transmissions or data even if Creative Futures Online Community has been advised of the possibility of such damages.
12. Remedies for Breach of these Terms by You 
In the event that the Creative Futures Online Community determines, at its sole discretion, that you have breached any portion of these Terms of Service, or have otherwise demonstrated conduct inappropriate to the Creative Futures Online Community, Creative Futures Online Community reserves the right to (i) warn you via e-mail that you have violated these Terms of Service; (ii) delete any content provided by you or your agent(s) to Creative Futures Online Community, (iii) discontinue your registration with Creative Futures Online Community (iv) notify and/or send content to and/or fully cooperate with the proper law enforcement authorities and/or agencies for further action; and/or (v) take any other action which Creative Futures Online Community deems to be appropriate.
13. Indemnification 
You agree to indemnify and hold each of the Creative Futures Online Community, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of Creative Futures Online Community, the violation of these Terms of Service by you, or the infringement by you, or any other subscriber of your account, or of any intellectual property or other right of any other person or entity.
14. Applicable Law 
These Terms of Service shall be governed by and construed in accordance with the laws of England.
